An anonymous blog that allegedly libels the principal at Norman Thomas High School is the subject of a application to a court by the principal to compel Google to disclose information about the blogger.

We don't know who the blog's author is either, but we do know that truth is an absolute defense to a libel action.
I'm so afraid that this court case is going to stop people from speaking out on this blog. I dare the principal of Bryant and any lawyer to disprove the facts brought up on this sight. Fact 1: our principal never once attempted to work with us to fix the DOE's issues with the school. Fact 2: our principal never once attempted to hear us out on any issue; instead she went after anyone who asked questions

she didn't have a personal problem with. Fact 5: she
hired back only 30%, when the Agreement called for 50% and other schools hired back over 80%. Fact 6: she made everyone jump through hoops all year, at the students' expense, only to get rid of key Bryant people who made the school what it was. Fact 7: She never once offered any helpful hint, idea, tactic, professional development, word, or letter to help us achieve what she and the DOE expected of us, because she, herself, had no such knowledge. Fact 8: she blamed us for wasting instructional time with anything that wasn't group work and spent twenty minutes stroking her ego on the loudspeaker every 3rd period and pulling failing students out for breakfast instead of, I don't know, leaving them in the classes they were in danger of failing. Fact 9: she bullied us into passing kids who didn't deserve it, holding unrealistically responsible for their grades and attendance, when even their parents or guardians gave up. Do I need to go on? This woman is a corrupt cog in a deficient system and we all need to speak out until these diseases like her, and our mayor, are held accountable for their crimes, and real, honest educational reform can begin.
Only in the teaching profession can employees get away with trashing their supervisors and being this disorderly.

Changing grades without the teacher's consent is a big problem that was going on in the school even before this principal came on board.
DeleteThat makes it a problem that needs to come to light. Doesn't matter at this point who else may have done it. We all knew this past year, Dwarka DID change grades, and for students who didn't even show up to class no less. It's illegal and she is guilty of it and will continue to be if kept there.

Veteran teachers are being unfairly rated unsatisfactory when they are doing satisfactory work. The UFT cannot negotiate with the DOE, until the DOE puts a stop to age discrmination. She is using coordinators to write observation reports, using them to go after teachers. She wants to demoralize you so you can quit. She said we need to get rid of half the staff. The DOE is the only place where they name and train principals to go after good veteran teachers. Even the students are fed up with the hypocresy and nonsense. Remember 8 assistant principals left, another one is being pushed out. Many teachers are planning to leave and others are being harassed to leave. What do you all do? ReplyDeleteWith all of this talk of evaluating teachers (as if we haven't been evaluated before), this editorial leaves out a very important and neglected piece of the puzzle: the quality of supervisors. Before Bloomberg and the "reformers," there was a career ladder in which only seasoned teachers, those with substantial classroom experience, were appointed as administrators. They were considered "master teachers" until Bloomberg decided that they were "managers."
ReplyDeleteWe now have scores of principals and assistant principals who lack the requisite experience and content knowledge to help classroom teachers improve their performance. We don't even require supervisors to have mastery of content; what we have now are supervisors who focus on style (how you teach, the arrangement of chairs, bulletin boards, stuff hanging on the walls, etc.) and virtually nothing on what to teach. Too many folks become supervisors to boost their pay quickly rather than use their experience We don't even have curriculum; anymore as teachers must design their own. We have APs licensed in math supervising teachers of Spanish and history. This is like having a plumber supervise an electrician or carpenter.
Until we revisit how we certify, train, and hire administrators, these new evaluations will be meaningless. At the very least, administrators should at least be NBPTS certified teachers (the gold standard for teachers) before they are allowed evaluate anyone.
The Danielson Framework in which we are going to be evaluated can only work when qualified supervisors develop professional relationships of trust and have regular dialogue on moving pedagogy forward. The reformers want a check-list for "gotcha" pop 15 minute observations. As teachers, we need regular feedback based on a supervisor's first-hand knowledge of content and pedagogy, not drive-by quickie observations.
What you write is absolutely true. Content knowledge is the least of their concerns. They try to evaluate teaching with a checklist. They are so off educational targets that it is amazing to watch. We do not know what to say anymore. We try to teach when they are not watching and wait for the pendulum to turn.

The principal of William Cullen Bryant HS in Long Island City, Queens, has rounded up more than 20 failing kids with behavior problems — and put them in a trailer where they stay all day.
Principal Namita Dwarka calls the boxy, red trailer housing the confined misfits “the Scholars Academy.”
Teachers come to the trailer for English, math, science, history and other classes. Even lunch is brought in. If kids go into the cafeteria, they are not served, one told The Post. The only break is phys ed in the yard, when a teacher “rolls out the balls.”
“Most of the kids are not happy with the situation,” a staffer said.

ReplyDeleteRecently, the news concerning the “The Scholar’s Academy” of William Cullen Bryant High School didn’t shock me at all. The actions and behavior of the current principal Ms. NamitaDwarka that I have seen as a student foreshadowed something as dreadful as this. As students, none of us ever had the courage to open up about how we really felt about her administration. The few that did had to enjoy the taste of detention in a room with no windows in the basement next to the women’s restroom…and that was because the students’ thoughts about her were publicly announced. Doesn’t that violate our first amendment? I wouldn’t think so; not just I, most of the students wouldn’t think so. Why would we? Why would we think of our rights at an educational organization where nobody cared about any ones opinions? As I would walk down the hallways, I would hear kids calling our beloved principal a “dictator” or a “sociopath” or a “fascist.” To be honest, I thought that was extremely disrespectful. Someone should never call others such things. “Treat others the way you want to be treated,” my global history teacher taught me this when I was a sophomore. Even though it was a little too much of the students, but after months of having her as a principal, when the kids say that to her, I’d leave it up to you to decide who was treating who wrong.
As a concerned alumnus, I would want a stop to this. And by “this,” I mean the torture that literally every single person in that building has to go through every day of their lives. Yes, I am extremely angry that Principal Namita Dwarka terminated teachers that have changed my life and that she had made senior year a nothing more than anguish, but that’s not it. I want the current students of Bryant have the same fun and educational experience that I had during my first three years there.

A third grievance filed by the UFT is about principals who are requiring teachers to submit “written goals” for their professional growth in the classroom. The exchange takes place during an “initial pre-conference” meeting, which is where teachers decided what kind of observations they want. (King created two options.)
ReplyDeleteThe department has warned principals not to request written goals unless their schools had opted into formal goal-setting as part of the evaluation process, raising questions about whether the department is intentionally allowing abuses to take place or whether the union is observing variation in implementation across the city.
Ms. Dwarka has rated veteran teachers unsatisfactory in order to win her sympathy from Tweed, she is pushing veteran teachers out and has pushed good assistant principals out. It is called engaging in age discrimination, when you constantly target the veteran teachers and hire inexperienced teachers while there are experienced ATRS with no positions. An investigation is on the way, we will not stop until all the corruption of the last 2 years is out. How come all these veteran teachers worked for many years under different supervisors and were never rated unsatisfactory? She rates teachers with good statistics because of personal grudges or dislikes. This is totally destructive and unacceptable.

If you look of all ATRs there are all middle age, and the teachers that get reassigned are also middle age. The median age of the staff of W.C. Bryant High School probably went down 15 years between 2011 and 2013. All the APs that were pushed out were veteran employees. The UFT knows about it and doesn't do anything.

A former Killybrooke Elementary School teacher is suing the school district for alleged workplace harassment and age discrimination, court records show.
Debbra DeMarco filed a lawsuit Sept. 4 in Orange County Superior Court against the Newport-Mesa School District and Killybrooke Principal Lorie Hoggard.
DeMarco, who was 43 years old at the time of the alleged harassment, claims the district forced her to quit because of her advancing age and because she was more expensive to keep on staff than a younger teacher.

She was paid $93,000 annually because of her 12-year tenure at the district and her advanced degree, said Joel W. Baruch, the attorney representing DeMarco.
"They can't legally discriminate against her because she's over the age of 40 and makes more money," he said.
The district declined to comment on the matter, according to a written statement by spokeswoman Laura Boss.
DeMarco, who has a doctorate degree in educational leadership from USC, began working at Killybrooke in August 2000 as a teacher in grades 3-5. She received tenure after working at Killybrooke for three months. She was a high performing and reliable employee, according to the complaint.
The alleged harassment began in 2011 when the district hired Hoggard as Killybrooke's principal. Soon after, DeMarco alleges that Hoggard began to harass, intimidate and discriminate against DeMarco, the complaint stated.
She accused DeMarco of drinking alcohol during the school day in October 2011 — an accusation DeMarco adamantly denied.
A month later, Hoggard asked her to submit her lesson plans for review on a regular basis and began coming into her class to observe her. From December 2011 through the end of January 2012, Hoggard would sit in DeMarco's class every day and observe, the complaint stated.
In January 2012, Killybrooke's school nurse, Marcia Marthaler, entered DeMarco's class in the middle of a lesson and smelled her breath. Marthaler allegedly reported to Hoggard that the teacher was under the influence of alcohol, according to the complaint.
That day, DeMarco received a letter from John Drake, director of certificated personnel, informing her that she was being put on paid administrative leave while the district conducted an investigation into allegations that she was drinking on the job. DeMarco was placed on leave for one day, according to the complaint.

Yes, you have the right to continue to keep the site up. Idealistic teachers with detailed action items have the right to try to inspire everyone with hopeful essays, and vindictive individuals with horrific writing skills have the right to continue adding to the vitriol. Opportunists have the right to cut & paste all of it onto more widely read blogs. The entire world has the right to read it. People like me who have not (yet) been personally attacked have the right to turn a blind eye to all of it. WordPress has the right to do whatever they want with it since they own the site.

Every personal attack on a Bryant employee reflects badly on our entire school. The few among us that are choosing to behave unprofessionally do not represent the vast majority of us who are completely opposed to the attacks and want our faculty to unite and move forward.

DeleteIt is time to put a stop to a principal who is not acting in the best interest of the students, and is trying to score a few points with TWEED by cleaning house with experienced employees. It is time to put an end to age discrimination, harassment, intimidation techniques and go back to professionalism, good work and to a supportive and more productive environment.

The chapter leader together with the principal will guide you through the process so you can get your termination papers ASAP, and the principal can look good for TWEED.

After being fired four years ago, Anthony Claudio, a special education teacher at Mattituck-Cutchogue Junior Senior High School, will be returning to the classroom following a ruling by a federal judge that he must be rehired because of age discrimination.
Claudio, 51, sued the Mattituck-Cutchogue School District after he was fired in 2009 while the majority of the other special education teachers were young women, many of whom had been tenured, according to Newsday.
"Discrimination is a form of bullying and that's something they are always trying to fight against" in school, Claudio said.
After finding that the district engaged in age discrimination, a federal jury awarded Claudio $70,000 in back pay, but rejected his additional claim of gender bias.
In July, U.S. District Judge Joseph F. Bianco in Central Islip denied the school district's appeal of the verdict and ordered Claudio’s reinstatement at an Aug. 1 hearing, citing evidence that the superintendent "initially agreed the plaintiff should receive tenure, but he then decided not to grant tenure, electing instead to terminate the plaintiff's employment."
The judge’s ruling requires that Claudio be reinstated in a probationary position but does not require the district to grant him tenure.
Witnesses at the trial, which included two school board members, said they believed Claudio's performance merited his becoming tenured.
Claudio's attorney, Frank J. Blangiardo of Cutchogue, said his client is entitled to the same seniority he had before his dismissal and should also be compensated for lost Social Security payments.
Bianco left the decision of whether to rehire Claudio for an open fifth-grade teaching position or find another way to reinstate him up to the district. "I don't think it's a good situation . . . for me to be micromanaging the district's decision on which teachers are best suited for which particular positions," he said, according to a transcript of the hearing.
But Smithtown attorney Yeltje DeJong, who represents the district, argued that Claudio doesn’t qualify for the elementary teaching position since his experience at that level is limited to substitute teaching. She further pointed out that Claudio lacks training in the required Common Core curriculum.
"The thought of putting a man in fifth grade where he hasn't had any experience and he hasn't had any training is frightening," DeJong said in court.
Claudio, who will resume an eight-year career with the district, said he would accept the fifth-grade position but would prefer his former job at Mattituck-Cutchogue Junior Senior High School.
“I loved my kids,” he said. “It's a wonderful feeling to know you helped educate kids. They say, ‘Hey, thanks for all your advice, I really used it.’”
New York Teachers Discrimination Lawyer – 3020-a Hearings
ReplyDeleteMost districts and individual schools have policies and training in place to address the issue of discrimination in the workplace. As a result, most principlals and superintendents should be aware of what the law says and what procedures must be followed when a teacher’s competence is called into question. Patterns of Discrimination – What to Look for

NEW YORK CITY, November 7, 2013 – The New York State Education Department (NYSED) issued a ruling this week on a complaint filed by Advocates for Children of New York (AFC) earlier this year, charging the New York City Department of Education (NYC DOE) with systemically violating the law by failing to provide crucial behavioral supports for students with disabilities. The NYSED decision affirms AFC’s claim that the NYC DOE must address students’ behavior using Functional Behavior Assessments (FBAs) and Behavior Intervention Plans (BIPs) as mandated by law.
“Recent statistics show that students with disabilities are suspended at a higher rate than other students,” stated Rebecca Shore, Director of Litigation at Advocates for Children of New York. “Schools are not following required procedures to identify causes of the challenging behavior or provide appropriate supports to prevent the behavior from occurring. Suspending students with disabilities results in missed class time and does nothing to address whatever is triggering the misconduct.”
Over the years, AFC has worked with thousands of families of students with disabilities and rarely seen appropriate behavior support plans from the DOE.
“We hope this decision will motivate the DOE to finally do the right thing for NYC students,” says Kim Sweet, Executive Director at AFC. “FBAs and BIPs were designed specifically to help students improve their behavior and increase positive experiences in school.”
NYSED found systemic noncompliance with the state regulations on mandated behavior support plans. In addition, NYSED found that the forms that the DOE uses do not comply with state requirements. Their investigation also concluded that the DOE does not provide sufficient support and guidance for its schools on positive behavior plans (FBAs and BIPs).
NYSED has ordered the NYC DOE to immediately remedy the system-wide violations and start providing students with disabilities the support they are legally entitled to.

We encourage everyone of you to send a letter to the parents to explain how are we being abused and mistreated and how it is affecting the level of stress in the building. We need to bring back a supportive environment like we had before, focusing on the students instead of being distracted by an abusive principal whose aim is to convince TWEED that she is doing a good job when we all know she is not.
ReplyDeleteprincipals are either hiding their vacancies or are selectively interviewing the youngest and cheapest of the ATRs when they cannot hide their vacancies. Of course if you ask the union or the DOE, they will claim that no such age discrimination is occurring. However, very few, if any older ATRs are getting any interviews. Now I read an article in Educationnext that showed that in Chicago, the younger principals do not like to hire older teachers and since many of the new generation of principals are younger and come from the infamous "Leadership Academy", they rather not have older teachers on their staff. In the article by Brian A. Jacob, a professor of education policy and economics at the University of Michigan, wrote the following:

ReplyDeleteThe Special Education Department had 2 assistant principals in a year, both were hard working people and the first one that was axed did the job of 5 people. This is outrageous that it is run by a teacher that suppose to be teaching 5 periods, and they are not in compliance with special education legislation. The students are being cheated with a proper education by this principal.

Principal Dwarka refuses to answer to CBS
ReplyDeleteHigh school senior M’Kayah Walker of Woodside, Queens, said she was injured while playing soccer.
“I was playing soccer. Kids fell on top of me,” she said. “And I found out my knees were dislocated.”
That sports injury has Walker struggling to get around on crutches. But she never dreamed it would disrupt her academic future.
She said making it up the steps and in to William Cullen Bryant High School in Woodside is painful.
Her mother requested home instruction for Walker, allowing the teen to graduate with her peers. The answer was no — not once, but twice.
“Just give me the home schooling so I can get my diploma,” she said.
Instead, the school issued her an elevator pass. But getting to it was tough and then she says she had to wait.
“They have taken more than 15 minutes to open the elevator,” she said. “When I use it, I’m late, and the teachers yell at me.”
CBS 2 attempted to speak to Bryant High School principal Namita Dwarka, but was told to leave.
When CBS 2 asked about Walker’s two petitions for home instruction, the Department of Education issued a response.
“Everybody has a right to request this service and it’s taken on a case by case basis,” the department said. “We’re still looking in to this.”
To help Walker avoid stairs, her guidance counselor and some of her teachers have been sending coursework home to her. But for every day she doesn’t walk in to the school building, she gets marked absent.
“I don’t know if it’s money, or if it’s incompetence, or whatever it is — it’s wrong,” said City Councilman Jimmy Van Bramer (D-26th).
Van Bramer said Walker is being “unnecessarily delayed.”
“She just wants to graduate,” the councilman said.
And the ordeal is not easy for Walker either.
“Now I’m depressed,” she said.
Walker waits to find out when she’ll graduate, eager to go on to college and major in psychology.
Next month, Walker gets surgery to repair her knee. Without home instruction, she believes she won’t be able to graduate until next summer.

I taught under six principals during my 28-year career at the same high school in the Los Angeles Unified School District, the nation's second largest. They ranged from excellent to execrable. I don't think the public understands the enormous power that principals possess as a result of the state education code, board of education policies and court rulings. How they choose to carry out their duties in large part determines their reputation among stakeholders. If principals decide that teachers are adversaries, rather than colleagues, they poison the atmosphere, and their tactics backfire.
Maybe it is time to say good-bye, we do not have a Union that care about us. This job is already hard enough, we do not need an administration that is constantly targeting us and harassing us. The only crime that we have committed is to grow old while doing our job. But with the experience we have accumulated by paying our dues, now under the present administration it seems we are making too much money because during years we did the right thing to get her

ReplyDeleteIt’s time for someone to devise a positive plan to restore Bryant H.S. after the removal of the current administration. A few suggestions:
1. Appoint a veteran educator and administrator (maybe a retiree) as interim principal for two years to get the school back on track.
2. Bring back all of the APs who were ousted by the current administration.
3. Seek out as many as possible of the former Bryant teachers who transferred out, and ask them to transfer back.
4. Break up the Academies ASAP and restore the departments as they were before “turnaround:”.
Statistics are also frequently used as indirect evidence to prove discrimination. For
ReplyDeleteexample, if the plaintiff can show that many people under forty have been given similar
positions, and only a few or no people over forty have, or if several employees 40 years
or older have applied for and been passed over for certain positions or promotions given
to younger employees, the plaintiff might be able to prove his/her case with statistics. If
the numbers are good enough, they can be very strong evidence of discrimination.
Damage awards in age discrimination cases can be very large. The law limits damages to
back pay (an employee’s salary and the value of her benefits since she was fired),
possibly front pay (if the plaintiff is likely to have great difficulty finding another job)
and plaintiff’s attorneys’ fees
61 percent of the teachers do not trust the principal, and 58 percent do not think she is an effective manager according to the latest survey of 2012-2013. Also, many teachers have answered that they trust her or that she is an effective manager with the intention of not hurting the school with the overall grade.
ReplyDeleteSeveral dozen students from William C. Bryant High School in Long Island City walked out of school on Friday, Nov. 8, demanding the removal of Principal Namita Dwarka.
ReplyDeleteGus Prentzis, head of the school's Parent Association, was in attendance acting as an observer. He chose not to give a statement, saying he preferred for people to hear about the issues in the school from the students themselves.
While many students were unaware of the reason behind the walkout, which occurred just before 11:30 a.m., several students were shouting and echoing excitedly, “They can't do anything, it's against the law for them to stop us.”
Across the street from the high school, a group of about 25 students was loosely gathered in front of a laundromat.
A DOE representative and two of the school's counselors attempted to speak with the students, but only a few were able to give specific reasons behind the walkout.
“We want a new principal because she's in another country right now,” said junior Felipe Aguilar, referring to Dwarka's trip to China. “She doesn't care about the students, she just cares about the money.”
Another student lamented the treatment of problem students.
“All the bad kids that cut and everything, they stay in one room all day, and they act like they're in prison,” said junior James Calle.
About a dozen students were brought back to the school after being picked up by the NYPD in a transport van, after which the students dispersed, some joining the crowd of protesters, others joining a crowd gathered around the fence surrounding the school's handball court.
A school administrator was ushering protesters out of the school's front lobby and sending them across the street. He said that the school was not going to be able to issue a statement until after they were able to get things organized.
“She doesn't care about our education,” said sophomore Andrew Morrero, who was among the students who walked out.
“She fired a lot of the good teachers, she got teachers that really don't know what they're doing,” he added. “Being that a quarter of the school walked out, that's good to stand up to get her out of the school. She shouldn't be the principal.”

Many good experienced teachers and professionals will not return home to W.C.Bryant High School. Their crime growing old and working hard in a system that discriminates you instead of rewarding you for loyalty and hard work. That is the reality we are losing and have lost many good people because they maybe at times too outspoken for an administration that was to control everything. Too much power in only one person is never good.

A Clovis Unified kindergarten teacher who alleges she was treated unfairly by her boss for years because of her age is suing the district, the latest move by the teacher to regain her job and be compensated for the alleged harassment.
The lawsuit filed Tuesday by teacher Carolyn Glenn, 65, alleges she was the target of repeated discriminatory and retaliatory conduct at Jefferson Elementary School by Principal Geoffrey Tiftick from 1998 to 2013.
The claim is similar to a complaint Glenn filed with the Equal Employment Opportunity Commission in July. That charge -- now under investigation by the EEOC -- says Tiftick gave her unwarranted poor reviews, showed preference to younger teachers and repeatedly forced her to switch grade levels.
It also alleges she was retaliated against when she refused to retire on several occasions.
On Monday, Glenn said she decided to sue after two internal complaints she filed were dismissed by district officials, who said Tiftick's actions did not constitute age discrimination.
"I've had no recourse from them," she said. "It's just brushed aside. My only recourse now is to go to a court of law."
She said she hopes the suit helps her regain her job and also prevents discrimination against her peers.
Glenn, who is on medical leave, is also seeking at least $300,000 in damages for emotional distress and compensation for medical expenses she's racked up since she's been off work.
The suit names both Tiftick and the district as defendants.
District spokeswoman Kelly Avants said Clovis Unified received a copy of the lawsuit Tuesday.
"We will review this lengthy document with legal counsel and take the appropriate next steps to respond in a timely manner," Avants said in an emailed statement.
Glenn said if she decides to go back to work she'd have to switch grade levels. She taught kindergarten last year but was reassigned to a different grade after she refused to retire last spring.
"I would like to" go back to work, she said. "It depends on what happens."

We were always a B school, actually she did not pull it off. College readiness had to do a lot, actually with a better principal in place we could have scored an A, the hard working staff of W.C, Bryant High School deserves all the merit and not the principal. Most teachers do not think she is an effective principal, they do not trust her and she is harming the school.
How can Dwarka possibly remain principal? For the last 2 years, she insulted, persecuted and humiliated numerous staff members (not to mention students); those teachers she didn’t manage to alienate during the school year, she did at the end by firing the majority of them. She has amply demonstrated she has a malicious, vindictive character – not least by attempting to stain teachers’ reputations and other employees purely for the sake of it by pointlessly ticking off unsatisfactory’s on our ratings sheet. Her leadership has never been about quality education; it was about intimidation. Teachers must work WITH a principal. Dwarka is a paid DOE employee like everybody else. Bryant is not her private fiefdom. Since teachers and administration must cooperate in order to run a school, and that cooperation is now impossible at Bryant, how can she remain principal? Because of her tactics of intimidation, harassment and age discrimination so many veteran employees got pushed out. We could have gotten a much better grade with a principal that we can work with.

ReplyDeleteThe differences between the city and the UFT are just as fundamental. The NYC Department of Education obdurately refuses to allow any independent appeal of a negative subjective evaluation by a principal – no matter how obviously wrong it might be. Many principals have shown themselves to be unfairly give poor evaluations to teachers in recent years, under the system of "principal empowerment," with little or no oversight from DOE.
ReplyDeleteNothing in this system would protect great teachers from vindictive principals or inherently volatile value-added test scores – and in fact, DOE has built in to its school funding system a poison pill that incentivizes principals to fire experienced teachers, since they have to pay for their higher salaries out of their school budgets.
Back in 2005 forty-five teachers filed a complaint with the EEOC that the DOE had discriminated against them because they were over 40 years old. The Daily News reported the filing and Randi Weingarten announced at the time that "88% of teachers brought up on disciplinary charges in the last three years were over 40."

Shocking report on the Bloomberg administration’s policy of dumping “over-the-counter” students into struggling schools or schools already set for closure. This as a terrible disservice to the students. For the already struggling schools, it was like throwing a concrete weight to a drowning man. Instead of support, the schools got the neediest students. It was a charade. Neither the students nor the schools got the help they needed. Was there no one at Tweed with a conscience? Or was it all a cynical numbers game, with students as the victims?

The city Department of Education has been harming rather than helping poor-performing public schools by assigning them many of the most challenging kids, according to a new analysis of enrollment data.
The study by the Annenberg Institute for School Reform, relying on data secured from the city by The Post, is the first to confirm complaints that struggling schools have been unfairly burdened with high-needs kids who enroll in the school system late.
The students who don’t participate in the regular high-school selection process — known as “over the counter,” or OTC, students — are likelier to be new immigrants, have special needs, be homeless or have a prior history of behavioral issues.
Yet the DOE knowingly assigned huge numbers of them to dozens of schools that were either already being shuttered for poor performance or that were subsequently approved for closure, the study found.
“Compelling evidence suggests that the DOE’s inequitable assignment of OTC students to struggling high schools reduces the opportunities for success for both the students and their schools,” said Norm Fruchter, an Annenberg associate and one of the study’s authors.
At Sheepshead Bay HS in Brooklyn, the percentage of OTC kids assigned each year grew from 18 percent in 2008 to 25 percent in 2011 — well above the average for large high schools. After the school’s performance began to suffer, it was approved for closure earlier this year.
In The Bronx, Christopher Columbus HS took in between 32 and 40 percent of its population over the counter each year from 2008 to 2010. Despite being approved for closure in 2011, it was still assigned 37 percent of its enrollment through OTC placements that year.
“We reconfigured our academic and support programs to meet the needs of our very sizable annual percentage of OTC students,” said Christine Rowland, a teacher at Columbus.
“But without sufficient resources, the burden on the school staff was enormous.”
DOE officials said that during the annual spring-enrollment process, the best high schools “tend to have the fewest seats available for students who enroll on the first day or midyear.”
Yet it wasn’t until state education officials expressed concern about the over-concentration of high-needs kids in struggling schools that the DOE began setting aside additional seats in the best schools last year.
